Terms and Conditions with regards to all purchases made from SDE, COD or 30 Account holders.

These Terms and Conditions shall constitute the agreement between SDE and the Customer. SDE shall not be bound by any representations,
warranties, promises or the like that are not recorded herein. These terms do not explain the opening a 30day account. It does not predict
any credit limit that may be offered or explain the payment terms of a 30day accounts. It constitutes the purchase agreement, the goods
received, the repairs and the return agreement. No alterations, cancellations, variations or additions hereto shall be of any force or bare
effect unless produced in writing and signed by the manager of SDE.
1. The ORIGINAL TAX INVOICE (overleaf of this same document) must be produced before any repairs will be undertaken or warranty will be
considered or validated. This document, bearing the product’s serial number, will be the ONLY valid document accepted with a return/repair.
Look after it. The stamped invoice will bear the signatures of the Picker, the Store man, the Sales person, the Customer or his appointed
courier confirming that the repeater was tested on a spectrum analyser to establish that it was amplifying – that all other goods were
picked and received at Dispatch correctly. Once this invoice has been signed there will be no dispute in this regard.
2. The factory warranty is 12 months from the date on original invoice and covers failure of components under normal use, which must include
using the voltage surge triptector provided, and plugged into a balanced 220V AC power source individually and not with other electrical
equipment running from the same electrical plug outlet.
3. Direct damages caused by lightning is not covered by SDE’s warranty. The use of a voltage surge protector/ lightning protector, which has its
own warranty, has also been provided as customer assistance for this purpose. Complete the Africa Surge warranty information form and
forward it with invoice number, serial number and product information to Surge Africa. This will validate surge protection insurance for the
repair of your appliance in case of surge/lightning related damage. A third party repeater specialist will determine the probable cause of the
failure and issue a report for repair/replacement for insurance purposes.
4. Installation of a repeater not done by an appointed, approved SDE installer will nullify ALL warranties. The repeater is NOT a DIY product.
5. The Installer will provide an after-sales customer service and is responsible to respond and support should an installation fail.
6. All repeaters are tested in the factory and have a factory test report to this effect. Repeaters are tested again on a spectrum analyser
before leaving our stores to the buyer. The customer is now responsible for thorough inspection of the goods before acceptance, and
agrees that the goods have been received in good order when placing his/her signature on the Tax/Copy Tax Invoice. Alleged defects must
be reported in writing within 7(seven) days. Failing to do this, all goods shall be deemed to have been in perfect working condition.
7. SDExperts has a large Africa customer base whom we serve by being responsive and acting quickly to their needs. The SDExperts
14- Day Returns Policy applies to all our invoiced products and all clients. If an item isn’t what the customer had in mind or for any reason
does not meet the customer’s needs or expectations, the customer is offered 14 days from the date of the invoice to return the item for
credit. The returned item must be in a perfect working and resalable condition (unused and in the original condition). Repeaters & radios
will be tested on our spectrum analyser) and must include all original fittings, power supplies in their original packaging, all attachments,
accessories and documentation. ( eg. test reports & manuals). The original invoice must accompany any return to SDExperts.
8. Handling fees will be charged when the condition of a product and/or it’s packaging is damaged. SDExperts reserves the right to refuse to
accept a return if the appliance is not in as new resalable condition or when the warranty of the product has been breached. It must be
understood that once the cellophane rapping has been removed, the appliance will be considered as second hand, warranties expired and
un-resell-able.
9. Testing of apparatus and system checks wil l be for the customer’ s account.
10. The installer has the option to take repeaters directly to the repairer and to consult with them directly as opposed to doing the repair through
SDE. SDE will only have repairs done to Amplitec and Connect Mobile brands they distribute.
11. All repairs carry a three-month repair warranty from date of the repair invoice of the repair company. Any delays in collecting repaired items
from SDE will thus be part of your repair warranty diminishing while product is not installed.
12. All repair costs are C.O D. and need to be settled before the goods are released. (This includes account holders of SDE)
13. A handling fee of 10% will be charged for any unopened/unused products returned after 7 days of the invoice date. SDE could have sold
this to another customer.
14. All goods accepted for repair and not collected within 1(one) calendar month shall be subjected to special and general lien and pledge for
monies due in respect of such goods or repairs. Should any amount owing by the customer to SDE in respect of any repair become due and
payable and remain uncollected for 1(one) calendar month, the company shall be entitled and the customer hereby authorizes the company
without first obtaining a court order, to sell any or all the goods for not more than the amount outstanding. The net proceeds of such sale
after deducting them from all costs, charges and expenses incurred by the company, shall be applied in reductions or discharge, of the
customer’s obligation to the company without prejudice to the company’s rights to recover any balance the customer remains owing after
the exercise of such rights.
15. The company does not accept liability for any loss or damages to items whilst in storage at SDE or at the Repairer or in transit with the SDE
driver.
16. Orders placed & invoiced not collected within 7 days of the invoice date will be cancelled and a handling fee of 10% will be charged.
17. Ownership of goods shall remain with SDE until payment in full thereof has been received. Any risk with regards to the goods shall pass to
the purchaser immediately upon delivery/acceptance of all or any part of such goods. Where delivery is carried out by courier such carrier
shall be deemed to be the purchaser’s agent and shall constitute delivery. Once dispatched, SDE ’s responsibility has been relinquished.
18. SDE shall not be liable for any loss, security breach or damage whatsoever suffered by the customer or any other person as a result of the
goods or any part thereof becoming defective in any way or failing to conform wholly or partially, with any warranty, guarantee or test report
given by the manufacturer; or any delay in delivering the goods or any part thereof; or any failure to deliver goods or any part thereof. The
company shall not be liable to the customer or to any other person for any loss of profit or other special or consequential damages
whatsoever arising out of any breach by the company of any of its obligations under these conditions or from any other cause whatsoever.
19. You hereby choose as your domicilium citandi et executandi for all purposes hereunder the physical address set out overleaf on this Tax
Invoice which address shall not be a PO Box or poste restante.
20. In the event that SDE has to institute legal proceedings against you in respect of the recovery of outstanding accounts then you
shall be liable for the payment of all legal fees on an Attorney and own client scale, collection commission and other legal charges in terms
of the Magistrate’s Court Act 32 of 1944, as amended.
21. SDE shall have the option to institute legal action or proceedings against you in a Magistrate’s Court of competent jurisdiction,
notwithstanding the fact that the amount claimed by it may be beyond the jurisdiction of a Magistrate’s Court.
The buyer or his couriers’ signature (on his/her behalf) on the overleaf of this document accepts these terms and conditions as contractual
and legally binding.
